Travel Advisor Service — Terms & Conditions
1. Acceptance of Terms and Conditions. These Terms and Conditions shall be deemed a part of, and are expressly incorporated by reference into any and all agreements entered between Turnpike Tour LLC, a Louisiana Limited Liability Company (hereinafter “Turnpike Tourl LLC” “we” “us” “our” and any similar derivations) and you the client (hereinafter “you” or “your”). Please also read all Terms & Conditions before using our Website, www.turnpiketour.com. By visiting and using the Website, you are consenting that you have read these Terms & Conditions, and agree to be bound by them.
By paying Turnpike Tour LLC the planning fee and/or deposit, you are affirmatively representing that you have read and accept the Terms & Conditions on behalf of yourself and anyone in your traveling party. Our Services as defined herein are limited to, and provided under, the terms stated herein. Terms contained in any other document, correspondence, or other forms that are additional to, or inconsistent with, the provisions in these Terms and Conditions are rejected.
2. Our Services: Turnpike Tour LLC acts as a travel advisor only. We sell various travel-related products on behalf of numerous transport service providers and accommodation service providers, including, but not limited to hotels, golf courses, car-rental company, or other service providers named in your itinerary or confirmation ("Suppliers"). Turnpike Tour LLC’s obligations to you are to make travel bookings on your behalf or to provide recommendations for independent booking, and to arrange relevant contracts between you and the travel service providers. We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. You understand that you have no legal recourse against Turnpike Tour LLC for the conduct of any travel service provider and your legal recourse, if any, is against the specific provider, not Turnpike Tour LLC.
3. Documentation: Travel documentation appropriate for entry to your itinerary destinations, such as passports, visas & inoculation certificates, remains each traveler’s sole responsibility. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel. A government-issued photo ID is required for travel within the USA. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.
4. Pricing and Payment: Price quotes are applicable to the date and time at which they are requested. Quotes in foreign currency are subject to fluctuations in exchange rates and International credit card issuer fees. Turnpike Tour LLC is not responsible for any increases due to fuel surcharges, government-imposed taxes/fees, or supplier-imposed increases. You may be required to make a deposit toward the cost of our services and such deposits are non-refundable. Final payment is required for Turnpike Tour LLC to complete the booking/reservations unless otherwise stated or agreed in writing. Some services must be paid in full at the time of booking. Turnpike Tour LLC accepts Paypal. If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, and not against Turnpike Tour LLC. In the event that payment has been made to us by credit card, you agree that you will not seek to charge back your payment to Turnpike Tour LLC. If the credit card is declined, you guarantee that you will settle any amounts owing to Turnpike Tour LLC immediately. Turnpike Tour LLC may charge interest on any invoiced amounts not paid within 30 days of the due date at a rate of 1.5 % per month.
5. Planning Fees: Travel planning involves a great deal of time and work. Our work is based on years of personal experience and professional expertise. We research destinations, hotels, tours, and activities in order to meet your specific needs. We contact suppliers, price multiple options, and draft itineraries before presenting you with proposals. For this, we will charge a planning or relationship fee. We are confident you will find our services, and the peace of mind and time savings they bring, are well worth the fee.
Once a fee has been discussed, we request that you submit payment of the non-refundable planning fee before we begin planning your trip.
6. Travel Protection/Insurance: Travel protection and insurance is strongly recommended to protect your investment. You are solely responsible for obtaining any travel protection and insurance you wish to purchase to protect the cost of your trip. Please note that most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of the claim by the travel insurer as it relates to COVID-19 or any other claim under the policy.
7. Cancellation: Please be aware that most travel bookings are non-refundable and canceled bookings will also often incur added charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify us for the amount of that fee or charge. This applies in instances when Turnpike Tour LLC pays suppliers directly. You agree to reimburse Turnpike Tour LLC the full amount of any such additional fees or charges within 20 days of receipt from us of documentation of the fee or charge. Turnpike Tour LLC does not issue refunds of any of its own fees for its Services.
8. Disclaimers of Liability.
Turnpike Tour LLC assumes no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at travel.state.gov, clicking on "Find International travel Information" then clicking on "Country Information", and filling in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at cdc.gov/travel, then clicking on "Destinations" and scrolling to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regard to the risks of COVID-19. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE, AND HOLD US AND OUR EMPLOYEES HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.
9. Price Volatility: Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. We shall make every effort to book the trip as requested, once booking fees are submitted. However, the Agency does not guarantee the availability of specific tee times, hotels, accommodations, excursions, or rental cars. As noted above, by making the booking, you expressly acknowledge your acceptance of these conditions applicable to your purchase.
10. Costs. Customer shall indemnify Turnpike Tour LLC for the cost and expenses we may incur in the collection of any unpaid balance of the agreed-upon price for the Services that are not timely paid by the Customer under the terms specified herein or under any subsequent contract executed by the parties. Such costs and expenses shall include but are not necessarily limited to Turnpike Tour LLC’s reasonable attorney fees incurred in such collection efforts, whether or not litigation must be filed in order to collect the aforesaid unpaid sums.
11. Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in New Orleans, Louisiana will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.
12. Entire Agreement. This document, together with any specifications, proposals, quotes, or other documents made a part hereof by attachment or incorporation shall constitute the entire agreement between the parties. The Terms and Conditions that govern the provision of the Services are limited to the terms and conditions specified herein, and the formation of any contract is expressly made conditional on your assent to these terms. These Terms and Conditions supersede all prior discussions, proposals, representations, and agreements. Turnpike Tour LLC will not be bound by any additional, different, or inconsistent terms in acknowledgments, invoices, emails, or other documents from you or by any course of conduct between the parties.
